Kush Marketplace – Delta 8 Restrictions

The Federal Government recognized Hemp (and Hemp Derived Cannabinoids) as a legal crop in 2018 with the passing of the Farm Bill. As of now, it does seem that Delta 8 THC fits within the farm bills standards as long as it doesn’t contain over .3% Delta 9 THC.. but every state can differ.

Currently there’s 17 States that have explicitly banned Delta 8 in Hemp Products (and other THC Isomers / Intoxicating Cannabinoids) including; Alaska, Arizona, Colorado, Connecticut, Delaware, Idaho, Iowa, Kansas, Michigan, Montana, Nevada, New York, North Dakota, Rhode Island, Utah, Vermont, & Washington.

Note: Virginia has banned delta 8 products from consumables like Beverages and Edibles.

Note: Minnesota does limit Delta 8 products to five milligrams of total combined THC – such as delta-9, delta-8 and delta-10 – per serving, with individual packages limited to 50mg.

If your not located in one of these states, then your in luck! For the time being it doesn’t seem there’s any laws prohibiting the buying and selling of Delta 8 products along with other federally legal hemp derived cannabinoids. But things can change fast, so make sure to check your local laws and regulations before making a sale or purchase.

Kush Marketplace – Other Banned Products

Unfortunately there are other product categories that kush.com currently can’t support because of state specific restrictions, general legality, or simply because they are unrelated to Hemp. These include the following product categories (but not limited too);

 – Non-Hemp related psychedelics like: Amanita Muscaria / muscimol / Kava Kava 
 – Kratom Products
 – Tobacco Products
 – Non-Hemp related substances or drugs
 – Weapons
 – Non-Products (like social media, other web sites)

Restrictions for the Consumer Facing Kush.com

On top of everything mentioned above, there are some additional restrictions placed on kush.com (More information about the Consumer Facing Kush.com Here). This is largely because we have to follow all merchant services limits to make consumer sales easy for everyone nationwide.

The main restriction being that all products available for consumer purchase must be <.3% Total Psychoactive Cannabinoids by volume.

Any products with more than .3% Delta 9 THC are already restricted federally, but with the current landscape we have to limit all cannabinoids including Delta 8 THC, to these limits. Thankfully, for products like edibles and beverages since the total weight of the product is considered, it is still very possible to have a psychoactive product that consumers will enjoy!

There are also a few product categories that we can’t yet approve for the Consumer Facing Kush.com. Some of the more popular categories include;

  • Filled Vape Products
  • Flower / Raw Materials
  • Prerolls
